Terms of Service

These Terms of Service ("Terms") govern access to and use of the SpicyGeny service, available at spicygeny.com (the "Service"). By creating an account or using the Service, you fully accept these Terms. If you do not agree, you must not use the Service.

1. Adults only

The Service generates adult content (explicit images and videos). It is strictly reserved for individuals who have reached the age of legal majority in their country of residence, and in any case at least 18 years old. By using the Service, you represent and warrant that you are of legal age. We reserve the right to suspend any account in case of doubt regarding the user's age.

2. Description of the Service

SpicyGeny is an AI content-generation platform that creates images and videos from text ("prompts"), reference images, or other user-provided media. The Service operates on a system of credits purchased separately.

3. Prohibited uses

You agree not to use the Service to create, upload, generate, or distribute:

• Any content depicting, suggesting, or involving minors or persons appearing to be minors, in any form whatsoever. Any such attempt results in immediate account termination and may be reported to the competent authorities;
• Content featuring identifiable real persons without their explicit consent (including any public figure);
• Non-consensual, violent, hateful, or otherwise unlawful content in your jurisdiction;
• Content involving animals or acts of bestiality;
• Any use intended to harass, defame, impersonate others, or infringe upon the privacy of a third party.

4. User responsibility for content

You are solely responsible for the prompts you submit and the content you generate, download, or share. When you upload a reference image, you warrant that you hold all necessary rights and, where applicable, the explicit consent of the persons depicted. You agree not to distribute generated content in any way that infringes third-party rights.

5. Credits and payment

Use of the Service requires purchasing credits. Payments are processed by our third-party payment provider. Purchased credits are non-refundable once the order is confirmed, except where mandatory law provides otherwise. Credits consumed by a successful generation are not restored. In the event of a technical failure during generation, the corresponding credits are automatically refunded to your account.

6. Intellectual property

To the extent permitted by applicable law, you retain the rights to the content you generate through the Service, subject to compliance with these Terms. The SpicyGeny brand, its interface, and its code remain our exclusive property.

7. Availability and no warranty

The Service is provided "as is," without warranty of any kind regarding availability, continuity, or fitness of the results for a particular purpose. We may interrupt, suspend, or modify all or part of the Service at any time.

8. Limitation of liability

To the fullest extent permitted by law, we shall not be liable for any indirect damages, data loss, or harm arising from the use or inability to use the Service, nor for your use of the generated content.

9. Suspension and termination

We reserve the right to suspend or delete, without notice, any account that violates these Terms, in particular Section 3.

10. Personal data

The processing of your data is described in our Privacy Policy.

11. Changes to the Terms

We may amend these Terms at any time. The version in force is the one published on this page. Your continued use of the Service constitutes acceptance of the updated Terms.

12. Governing law

These Terms are governed by the law applicable at the publisher's place of establishment. Any dispute falls under the jurisdiction of the competent courts of that jurisdiction.
